The petitioner, already in custody, seeks bail in connection with Spl.(POCSO) Case No. 26 of 2018 arising out of Palasi P.S.Case No. 142 of 2018 registered under Sections 366A and 372/34 of the Indian penal Code and Section 8 of the Protection of Children from Sexual Offences Act. Allegation in brief is that accused persons enticed away the daughter of the informant for the purpose of marriage. Submission is that girl in her statement recorded under Section 164 Cr.P.C. has stated that she has voluntarily married with Indal Yadav, another co-accused, and there is no whisper against this petitioner of giving any assistance in elopement moreover girl is major as she has stated that her age is 18 years and the court has also assessed her age of 17 years.

Sessions cum Spl. Judge, Araria in connection with Spl. (POCSO) Act Case No. 26 of 2018 arising out of Palasi P.S. Case No. 142 of 2018.
