The petitioner seeks bail in connection with Rajapakar (Baranti O.P.) P.S. Case No. 47 of 2022 dated 09.02.2022 instituted for the offence under Sections 341, 323, 324, 307, 354, 379, 448, 427, 504, 506 and 34 of the Indian Penal Code.

The accusation in the FIR is that on the orders of the petitioner, who is one of the agnates of the informant as also the accused persons, Krishna Kumar and Bishna Kumar assaulted the informant as a result of which he received injuries.

The learned counsel for the petitioner has submitted that no positive overt act has been attributed

Patna High Court CR. MISC. No.51693 of 2022(2) dt.22-12-2022 2/2 against him and earlier also, because of his having sided with the accused persons in a family dispute. He was made accused at the instance of the informant. In all such cases, the petitioner is on bail.

In the present case, the petitioner is in custody since 27.05.2022.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IX, Vaishali at Hazipur in connection with Rajapakar (Baranti O.P.)
