2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/406/467/468/120B of the Indian Penal Code.

3. As per the prosecution case, this petitioner had taken Rs.2 lacs from the informant for providing him job in the Railways but neither he provided job nor did he return the said amount to the informant.

4. Learned counsel appearing for the petitioner denies the allegation and submits that no amount was ever credited to the bank account of the petitioner by the informant in this regard. It is further submitted that agreement to secure appointment by unfair means is itself unlawful and prohibited under law. Informant, voluntarily parted with money for an illegal purpose, cannot be allowed to urge that he has been cheated. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of

No.54011 of 2023(2) dt.21-08-2023 2/2 arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Patna in Gandhi Maidan Police Station Case No. 592 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
