A supplementary affidavit along with the injury report of the husband of the informant has been furnished. Let it be kept on record.

Heard the learned counsel for the petitioner and learned APP for the State.

The learned counsel for the petitioner has submitted that there is land dispute between the parties. The specific allegation against the petitioner is that he assaulted the husband of the informant on head, who sustained simple injury. The petitioner is a person of clean antecedent.

No.52192 of 2022(4) dt.24-01-2023 2/2 Considering the above facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner abovenamed, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K.Nagar P.S.Case No. 494 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
