2. The petitioner is apprehending his arrest in connection with Complaint Case No. 3022 of 2021 for the offence under Sections 498A of the I.P.C.

3. As per the prosecution story, the complainant has alleged that her marriage was solemnized with the petitioner on 06.05.2021. Thereafter, when she came to her matrimonial home, she came to know that her husband has illicit relation with his sister-in-law - Babita Devi who is a widow lady. It is further alleged that the petitioner is mechanic and he is working in Dhanbad. For opening of his own garage, he demanded Rs.

Patna High Court CR. MISC. No.55976 of 2024(4) dt.05-03-2025 2/3 5,00,000/- from the complainant, for non-fulfillment of same the complainant was subjected to torture variously.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has falsely been implicated in this concocted case by O.P. No. 2 with ulterior motive. No specific role attributed to the petitioner except a suspicion that petitioner is in love with one Babita Devi who is widow lady and sister of co-accused Munni Devi. The petitioner is a mechanic in a private motor garage at Dhanbad. O.P. No. 2 does not want to live with co-accused persons in village and petitioner is unable to keep her at Dhanbad. Learned counsel further submits that as the petitioner is mechanic and earns only Rs. 8,000/- per month still he is ready to pay Rs. 3,000/- for maintenance of his wife.

5. Learned APP opposes the prayer for bail

6. Taking into account the fact that the petitioner is still ready to pay the maintenance to his wife, which presently shows his bona fide conduct, this Court is inclined to extend him the privilege of anticipatory bail.

7. Petitioner - Akhilesh Kumar is directed to pay the above amount of maintenance within the 10th of each month from receipt of copy of this order as per his own undertaking

Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned S.D.J.M., Saran, Chapra in connection with Complaint Case No. 3022 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
