JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323,354B and 506/34 of the Indian Penal Code.

The prosecution case, in short, is that on 03.03.2016 while the informant was with her daughter-in-law, the petitioner came with his three friends at informant's house and started abusing her in filthy language by calling her caste name. On protest being made the petitioner threatened on pistol point. Thereafter the informant informed the police but accused escaped from the scene. The accused again came to informant's house at 7 P.M. when he caught hold of the informant, abused and pulled her blouse. When the informant raised alarm, then the petitioner pushed her in a

It is submitted by learned counsel for the petitioner that earlier the petitioner has filed a case, being Nathnagar (Masudanpur) P.S. Case No.141 of 2015, levelling allegations under Sections 147,148,341 and 307 of the I.P.C. against the informant wherein the informant is facing trial, hence as a retaliatory measure the present case has been lodged against the petitioner. A statement has been made in paragraph No.3 of the petition that the petitioner has got no criminal antecedents. Considering the aforesaid facts and circumstances, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No.78 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Dinesh Kumar Singh, J) V.P.Sinha/- U
