CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 07-11-2025 Heard learned counsel for the petitioner and learned counsel appearing for respondents-State.
2. Learned counsel appearing for petitioner submits that he wants to withdraw the present writ application with
4/4 liberty to pursue his remedy before the District Appellate Authority, Nalanda.
3. As prayed for by learned counsel for the petitioner, this case is disposed of granting liberty to the petitioner to seek redressal of his grievance before the District Appellate Authority, Nalanda. On the issue of limitation the District Appellate Authority will take into consideration the pendency of the matter before Hon'ble High Court.
4. It is further made clear that the final order which shall be passed by the District Appellate Authority, Nalanda should be a reasoned and speaking order and proper opportunity should be granted to the petitioner in the proceeding. It is also made clear that the entire proceeding before the District Appellate Authority to be concluded within a period of six months from the date of filing of the appeal.
5. With the aforesaid observation and direction, the present writ application stands disposed of. Pending I.As, if any will be deemed to have been disposed of.
