ANJANA MISHRA ORAL ORDER 28-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 20.05.2018 in connection with Sahodra P.S. Case No. 38/2018 registered for the offences punishable under Sections 2/9/27/31/32/39/44/49B/50 and 51 of the Wild Life Protection Act and Section 379/427 of the Indian Penal Code.

Allegation against the petitioner is that, on a search of his premises, two horn of Hiran, one v size horn containing two branches and another Horn of Hiran having three branches and others articles which were scheduled articles under than Wild Life Protection Act, 1972, were recovered and as such the petitioner having no explanation for the same, was taken into custody.

Patna High Court Cr.Misc. No.46007 of 2018 (2) dt.28-08-2018 2/2 Learned counsel for the petitioner submits that the entire allegation against the petitioner is false and frivolous and he is willing to face trial. It is further submitted that the said recoveries have been planted and it is on account of village politics that he has been implicated in connection with the present case. He further submits that as and when required, he shall present himself before the investigating authority as well as during the course of the trial.

Taking into consideration such facts and circumstances that the petitioner has got no criminal antecedent especially of the same nature, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge-cum-Special Judge, West Champaran at Bettiah, in connection with Sahodra P.S. Case No. 38/2018.
