Mr. Ajay Kumar No.1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Fatuha P.S.Case No. 20 of 2017 registered under Section 387 of the Indian penal Code.

Allegation in brief is that the petitioner demanded extortion money from the informant otherwise would not be allowed to do construction work of the bridge. Submission is that the petitioner's land is situated beside the construction site of the bridge so objected of keeping the construction materials there, so, on that account petitioner has been falsely implicated in this case but has had no criminal antecedent prior to institution of the present case. Subsequently two cases were instituted against him and in those cases he is on bail.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.44929 of 2018(3) dt.27-07-2018 2/2 the petitioner, namely , Lalbabu Gope @ Lalbabu Singh is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class in connection with Fatuha P.S. Case No. 20 of 2017 with condition that if he is found indulged in similar kind of crime then his bail bond shall liable to be cancelled.
