Heard the learned counsel for the petitioners as well as Mr. Bhanu Pratap Singh, the learned Additional Public Prosecutor for the State through video conferencing. The petitioners apprehend their arrest in connection with Barahiya P.S. Case No. 172 of 2021 registered for offence punishable under sections 323, 341, 308/34 of the Indian Penal Code.

No.61490 of 2021(2) dt.15-07-2022 2/3 As per allegation, in the morning of occurrence, the informant saw that the petitioners, Raj Kumar Singh, Shailendra Singh and Rupesh Singh along with Amit Kumar and Karn Kumar were dismantling the drainage of the informant. On protest, they assaulted the informant with brickbats etc. The learned counsel for the petitioners has submitted that petitioners are innocent. Petitioner no. 1 has lodged case against the prosecution side for the same day occurrence. He has submitted further that though one injury was found grievous on the person of the informant, but during the course of investigation, it has emerged that the prosecution side had blocked the drainage of the house of the petitioners. The petitioners are the persons of clean antecedents.

Considering the fact that during the course of investigation it has emerged that the prosecution side had blocked the drainage system of the petitioners' house and also considering the fact that the petitioners are the persons of clean antecedents, let them, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P.S. Case No.
