The petitioner, Ramnath Sahani, apprehends his arrest in Turkaulia P.S. Case No.172 of 2014, registered under Sections 366A and other sections of the Indian Penal Code. Bhaiyaram Rai, the informant, made allegation that his minor daughter, Mintu Kumari, was enticed away by Radhika Devi and Prabha Devi. Jagdeo Mahto also helped them in kidnapping his minor daughter.

Learned counsel for the petitioner submits that the petitioner is not named in the first information report. During the course of investigation, some of the witnesses have simply raised suspicion that the petitioner also helped Radhika Devi and Prabha Devi. It is submitted that the petitioner is an old man, aged about 59 years and he is suffering from different ailments. It appears that only suspicion has been raised against

Patna High Court Cr.Misc. No.916 of 2015 (2) dt.09-01-2015 2/2 the petitioner that he might have helped Radhika Devi and Prabha Devi and there is no specific allegation against him of taking away the minor girl.

Having considered the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S. Case No.172 of 2014, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
