JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,376/511,379 and 504/34 of the Indian Penal Code. The prosecution case is that the accused persons were cutting soil from the purchased land of the informant when the informant made protest then the accused persons assaulted the informant. Co accused Birju Raut ordered Ramesh Raut to kill the informant by putting a stick in the anus of the informant. Ramesh pulled the informant down and put the lathi in the anus. Thereafter, the petitioner alleged to have made attempt to ravish the informant's wife.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.22939 of 2016 (2) dt.23-05-2016 2/2 that in the background of litigated relationship the accusation has been levelled. It is further submitted that for the occurrence of 11.2.2016 the FIR has been registered on 18.2.2016. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the thrust of accusation against co accused Ramesh Raut and delayed lodging of the case, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Pupri at Sitamarhi in connection with Bajpatti P.S. Case No.26 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
