The petitioner apprehends his arrest in Akbarpur P.S. Case No. 16 of 2016 registered for the offences punishable under Section 420 and 409 of the Indian Penal Code. The petitioner being the Headmaster of Nav Pratmik Vidyalaya, Azad Nagar, Block Akbarpur was entrusted with Rs.4,90,000/- for construction of school building estimate of which was Rs.6,60,000/- in the financial year 2007-08. Learned counsel for the petitioner submits that the petitioner purchased bricks and chips of Rs.90,000/- but the villagers began to quarrel with each other and the construction work was not allowed to be done. Petitioner is ready to deposit the amount.

No.22792 of 2016 (3) dt.26-07-2016 2/2 It appears that the petitioner received Rs.4,90,000/- in the financial year 2007-08 and for last eight years the petitioner neither constructed the school building nor he deposited the amount in the government exchequer and he has defalcated Rs.4,90,000/-.

Considering the facts aforesaid, I am not inclined to grant the petitioner anticipatory bail and the same is rejected. Kundan (Prabhat Kumar Jha, J.) U T
