JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Sherghatti P.S. Case No. 612 of 2018, disclosing offences under Sections 341, 323, 452, 354, 504, 34 of IPC.

Allegation against the petitioners is that they entered inside the house of the informant and also misbehaved with her and on hulla, they succeeded in fleeing away, after assaulting her mother also.

Submission of the learned counsel for the petitioners is that petitioners no.2 and 3 are the sons of the petitioner no.1 and in such a situation, allegation of misbehaviour with the

Patna High Court CR. MISC. No.47329 of 2019(2) dt.30-07-2019 2/2 informant by all the accused persons does not appear to be porbable. On the other hand, petitioners' side has also lodged a complaint against the informant and other, three days prior to the occurrence and as a counterblast, the present case has been lodged.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M., Sherghatti, Gaya, in connection with Sherghatti P.S. Case No. 612 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
