2. Petitioner seeks regular bail in connection with Paharpur P. S. Case No. 476 of 2023 in a case registered for the offences punishable under Sections 447, 341, 342, 323, 324, 325, 307, 354, 379, 506/34 of the Indian Penal Code.
3. Allegation against the petitioner is that he along with other F.I.R. named accused persons assaulted informant and his family members by means of farsa, lathi, iron rod, etc. as a result of which father of the informant got badly injured and died during course of treatment.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation of assault is general and omnibus. Petitioner claims clean
Patna High Court CR. MISC. No.52990 of 2025(3) dt.03-11-2025 2/2 antecedent and is in custody since 06.04.2025.
5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is named in the F.I.R. with specific accusation that he along with others assaulted the deceased and others with deadly weapons.
6. Considering the nature of accusation, prayer for bail of the petitioner is rejected. However, since petitioner is in custody since 06.04.2025, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
