The petitioner, who is in custody, seeks bail in connection with Aurangabad (Mahila) P.S. Case No. 16 of 2018 registered for the offence punishable under Sections 366(A), 376, 420 of the Indian Penal Code and 4 of POCSO Act. Informant is the victim, who in her written complaint made before the Officer-in-Charge, Aurangabad Mahila P.S., Bihar, in which she has alleged that she is aged about 17 and half years. On 06.05.2018 petitioner took informant at his home on promise of marriage with her and kept her in his house for seven days. Thereafter she came back
Patna High Court Cr.Misc. No.46828 of 2018(2) dt.08-08-2018 2/2 to her parental home and they were in conversation with each other for last one year. They had also visited many places together and petitioner had also given a mobile to her. From statement made in FIR it appears that she accompanied petitioner willingly. Informant has nearly attained the age of majority. It has been further submitted that petitioner has no criminal antecedent and both were on visiting term. It has further been submitted that petitioner is in custody since 18.05.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-Ist-cum Spl. Judge, (POCSO), Aurangabad, in connection with Aurangabad (Mahila) P.S. Case No. 16 of 2018. (S. Kumar, J) veena/rajivU T
