The Petitioners apprehend their arrest in Main (Paibigha O.P.) P.S. Case No. 24 of 2014 under Sections 420, 406 and 379 of the Indian Penal Code.
The informant Ram Niwas Sharma @ Ramanji Sharma alleged that the petitioners have taken thumb impression on a non-judicial stamp paper on the pretext of getting his son released.
Learned counsel for the petitioners submits that the complainant-informant did not allege that his signature was ever misused by the petitioners. The petitioners did not take any signature or thumb impression of the informant on any paper. On
Patna High Court Cr.Misc. No.714 of 2015 (2) dt.08-01-2015 2/2 account of some land dispute, the case was filed, that too, after much delay.
Having considered the facts that the dispute appears to be of civil nature, let the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be released on anticipatory bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Main (Paibigha O.P.) P.S. Case No. 24 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
