JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under various sections of the Indian Penal Code.
According to prosecution case itself, more than 200 persons attacked on the house of informant and assaulted the inmates of house including the brother of informant and also committed loot of belongings of the house.
Submission on behalf of the petitioner is that although petitioner is named in the first information report but as a matter of fact, petitioner happens to be 95 years old person and he
Patna High Court Cr.Misc. No.43612 of 2018 (2) dt.20-07-2018 2/2 cannot move even without taking help of others. It is further submitted by him that petitioner has been roped in this case on account of village politics. In support of his contention, he drew my attention towards Annexure-2, photostat copy of Aadhar Card of the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 272 of 2018.
