The petitioner seeks bail in Sadar (Mufassil) P.S. Case No. 126 of 2018 registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has been falsely implicated in this case. It has been further submitted that the statement of girl namely Khushbu Kumari was recorded under Section 164 of the Cr.P.C in which she has stated that she had married with the petitioner on her own volition and sweet will as they love each other. Petitioner has got no criminal

Patna High Court Cr.Misc. No.45710 of 2018(2) dt.27-07-2018 2/2 antecedent and is custody since 07.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar (Mufassil) P.S. Case No. 126 of 2018.
