2. The petitioner has preferred this application for grant of regular bail in connection with Cyber P.S. Case No. 47 of 2025 dated 19.04.2025 registered for the offences punishable u/ss 303(2), 318(2), 318(4), 319(2), 336(2), 336(3), 340(2) and 61(2) of the B.N.S. and Sections 66 and 66D of the I.T. Act.
3. As per the prosecution case, on 19.04.2025, on the basis of tower location of mobile number 9142391171 provided by EOU, Patna, police went to the village- Saur, P.S. Warsaliganj. On seeing police, two persons started to flee away but one person was apprehended and the other escaped. The apprehended person disclosed his name as Saurya Kumar
Patna High Court CR. MISC. No.49771 of 2025(4) dt.15-11-2025 2/3 (petitioner). On search, one mobile phone was recovered and at the instance of the petitioner, two more mobiles were also recovered from a nearby field. The petitioner also disclosed the name of the absconding person as Rahul Kumar. The petitioner also confessed that both of them used to cheat people by pretending to provide loans under the Pradhan Mantri Mudra Yojna and the other schemes.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has not cheated any persons as alleged in the F.I.R. The charge-sheet has been submitted against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.49771 of 2025(4) dt.15-11-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Cyber P.S. Case No. 47 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
