JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-08-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bhagwanpur P.S. Case No. 84 of 2019 for the offence under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-a) b / 35 of the Arms Act.

The petitioner was apprehended by the police on the allegation that he and others were preparing plan for commission of serious offence.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 13.04.2019. It is alleged that one Samsung Mobile and Rs.200/- was recovered from the possession of the petitioner.
