The petitioner seeks bail in connection with Prabatta (Maraiya) P.S. Case no. 209 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act-2016. 186.48 lts. of foreign liquor is said to have been recovered from the house of the petitioner kept there by accused Anil Yadav and Amrit Yadav with consent of the petitioner and she was apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. She has no concern either with the seized liquor or with any trade of liquor. She happens
Patna High Court Cr.Misc. No.46273 of 2018(2) dt.31-07-2018 2/2 to be widow and old lady aged about 65 years. She had simply allowed the aforesaid accused to keep their cartoon in her house without knowing its contents, in the meantime, police raided her house and seized the aforesaid cartoon containing liquor. She has no criminal antecedent. She has been languishing in custody since 14.06.2018. Said Anil Yadav and Amrit Yadav have been enlarged on bail by a co-ordinate Bench of this Court vide order dated 25.07.2018 and 19.07.2018 passed in Cr. Misc. no. 44580 of 2018 and 42167 of 2018, respectively. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-I, Khagaria in connection with Prabatta (Maraiya) P.S. Case no. 209 of 2018.
