The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 364/34 of the Indian Penal Code.

The prosecution case is of abducting the minor daughter of the informant.

In 164 Cr.P.C. statement the victim has got her age recorded as 18 years when the Court has assessed as 16 years where she has stated that she went in the company of the petitioner of her own will.

It is submitted by learned counsel for the petitioner that the occurrence is of 18.06.2014 and the F.I.R was lodged on 25.06.2015 i.e. after the lapse of one week.

No.24293 of 2016 (2) dt.31-05-2016 2/2 Considering the aforesaid facts, let the learned Court below consider the prayer for regular bail of the petitioner if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Neemachak Bathani P.S. Case No. 105 of 2015, pending in the Court of A.C.J.M, Gaya.

With the aforesaid observation, this application is disposed of.
