The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No. 265 of 2021 registered under Section 30(a)/30(d) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Only on the confessional statement of the co-accused, the name of the petitioner has been transpired in the instant case. Further he submits that from perusal of seizure list, it appears that the alleged recovery has been made from the joint house of the petitioner. It is also submitted that petitioner is a man of clean antecedent. Having considered the facts and circumstances of the

Case No. 265 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
