The petitioners seek bail in Kalyanpur P.S. Case No. 75/2018, registered under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.
11.250 liters of foreign liquor is said to have been recovered from the bush located behind the poultry farm of Monu Kumar Singh, which is said to have been kept there by the petitioners after purchasing the same from Monu Kumar Singh. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from the
Patna High Court Cr.Misc. No.43468 of 2018 (2) dt.19-07-2018 2/2 conscious physical possession of the petitioners. They have no concern either with the seized liquor or with the place of recovery. They have been falsely implicated in this case by the said Monu Kumar Singh due to enmity while they were standing near the place of occurrence. They have no criminal antecedents and have been languishing in custody since 19.05.2018. Other co-accused, namely, Monu Kumar Singh has been enlarged on bail by this Court in Cr. Misc. No. 38447/2018 dated 02.07.2018. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-VI-cum-Special Judge, Excise, Samastipur, in connection with Kalyanpur P.S.
