====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 09-08-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

A prosecution report without proper investigation of the case was submitted on recovery of foreign liquor from the four wheeler on which the petitioners were there. Petitioners have stated on oath that they have got no criminal antecedent. Considering the facts aforesaid, let the petitioners, above named, be released on bail after framing of charges or completion of two months of custody whichever is earlier on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand)

Patna High Court CR. MISC. No.49414 of 2019(2) dt.09-08-2019 2/2 each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with P.R. Case No. 06 of 2019 and Misc. Excise Case No. 435 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
