2. Petitioners apprehend arrest in a case registered for the offences punishable under Section 376(D)/34 of Indian Penal Code.

3. It is alleged that all the F.I.R. named accused persons committed gang rape with the informant. It is further alleged that co-accused Saron Bin threatened her, on the point of pistol, with dire consequences if she discloses this ordeal to anyone.

4. It is submitted that the petitioners have falsely been implicated in the present case as neither they are named in the

Patna High Court CR. MISC. No.55290 of 2023(2) dt.24-08-2023 2/2 F.I.R. nor the victim has disclosed their names in her statement, recorded under Section 164 of Cr.P.C. Petitioners have got clean antecedent.

5. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Mahila P. S. Case No. 2 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
