The petitioner seeks bail in Ara Town P.S. Case No. 230 of 2018 registered for the offence punishable under Sections 414, 401, 467, 468, 471 and 120(B) of the Indian Penal Code. Informant is the police officer who in his written complaint has stated that on 21.04.2018, he was checking the vehicles and one motorcycle on seeing the police party tried to flee away and thereafter he was apprehended and disclosed his name as Jhulan Yadav and could not produce the ownership papers of the vehicle and also confessed that it is stolen motorcycle.

It has been contended on behalf of petitioner that he is innocent and has been falsely implicated in this case. The name

Patna High Court Cr.Misc. No.45643 of 2018(2) dt.27-07-2018 2/2 of the petitioner has transpired in this case only on the basis of confessional statement made by said Jhulan Yadav. Nothing has been recovered from the possession of the petitioner. Petitioner has got no criminal antecedent and is in custody since 22.04.2018. It has been further submitted that similarly situated co-accused namely, Birbal Yadav has been granted bail by a coordinate bench of this Court vide order dated 13.07.2018 passed in Criminal Miscellaneous No. 34661 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, in connection with Ara Town P.S. Case No. 230 of 2018.
