JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 504 and 506 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant but at earlier point of time, the informant lodged Complaint Case No. 735 of 2009 with similar accusation wherein the petitioner has been granted bail, statement to that effect has been made in para 3 of the petition. The petitioner has also filed Matrimonial Suit No. 81 of 2012 on 02.04.2012 with a prayer for divorce, though, the informant has filed matrimonial case also.

No.21987 of 2016 (2) dt.17-05-2016 2/2 Considering the fact that in earlier case, the petitioner has been granted bail and matrimonial suit has been filed prior to the lodging of the present case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri-on-Sone, Rohtas in connection with Rohtas (Amjhour) P.S. Case No. 148 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
