Learned counsel Mr. Abhijit Abhigyan appeared and submits that he has been instructed by counsel on record that file is misplaced in his chamber therefore, adjournment may be given.
It transpires from the record that on 17.01.2023, this case was listed and petitioner was requested to adjourn this matter due to personal difficulty. On 02.02.2023 again, this matter was listed and counsel for petitioner was taken adjournment in this case due to his personal difficulty. Again on 21.02.2023, upon repeated call, no one appeared and matter was
Patna High Court CR. REV. No.105 of 2017(8) dt.28-03-2023 2/2 adjourned. Again on 28.02.2023, this case was adjourned on the request of the counsel for the petitioner.
Today, counsel for petitioner has not appeared and he has sent somebody else to take time in this case. From the conduct of the counsel, it transpires that he is not interested to pursue this case.
In this view of the matter, this case is hereby dismissed due to non-prosecution.
