JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 504/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The accusation is of making assault with sickle and abusing the informant by calling caste name.

It is submitted by learned counsel for the petitioner that the injury report is not on record. A statement to that effect has been made in para 8 of the petition. Moreover, admittedly, the accusation has been levelled in the background of some hot discussion between the wives of the petitioner and the informant and the informant has subsequently retracted from his initial version. A statement has been made in para 3 of the petition that

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Kanhauli P.S. Case No. 107 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
