The petitioner apprehends his arrest in Ara Nawada P.S. Case No.777 of 2018 registered under Sections 307, 34 of the Indian Penal Code and under Section 27 of the Arms Act. There is specific allegation that it was petitioner, who was pillion rider of a motorcycle, made firing causing firearm injury on the thigh of the informant.
The learned counsel for the petitioner submits that petitioner and the informant are students and they are residing in the same locality. Good sense has prevailed and a compromise petition is also filed but it appears that the petitioner made an abortive attempt to kill the informant by making repeated firing out of which one hit the thigh of the informant and also the petitioner made an attempt to tamper with the evidence by filing
Patna High Court CR. MISC. No.52739 of 2019(2) dt.23-08-2019 2/2 compromise petition in such a heinous offence in which petitioner made firing in the broad daylight. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
