The petitioner, Md. Faruk, is apprehending his arrest in Complaint Case No. 1016-C/2013 registered under Section 366 of the Indian Penal Code.
The complainant filed Complaint Case No. 2033C/2009 and the same was sent for registration on the basis of which Nauhatta P.S. Case No. 109/2011 was registered. The police, after investigation, submitted final form finding the case false. Thereafter, the present case proceeded on complaint. The complainant alleged that his daughter was kidnapped by Md. Faruk, the petitioner.
Considering the fact that the accusation was found false by the police during the course of investigation and,
Patna High Court Cr.Misc. No.2218 of 2015 (2) dt.19-01-2015 2/2 thereafter, the present case proceeded on protest, let the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be released on anticipatory bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Complaint Case No. 1016-C/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
