Mr.Nawal Kishore Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-08-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Hisua P.S. Case No. 123 of 2019, registered under Sections 341, 323, 504, 506, 307, 379, 354(A) and 384/34 of the Indian Penal Code.

No.49377 of 2019(2) dt.07-08-2019 2/3 The accusation is that on 20.03.2019 at about 10 A.M., all petitioners and 7-8 unknown came at the house of informant, Shivdani Singh, and Ahsish Kumar (petitioner no. 1) made demand of Rs.50,000/- as ransom. When the informant made protest then Gulshan Kumar (petitioner no.2) caused injury at his finger with iron rod and Chhote Kumar (petitioner no.4) assaulted him with iron rod causing injury at his left hand. When his daughter-in-law, Renu Sinha and grandsons, Raja Babu and Suman Nirmal came to save him then Bipul Kumar (petitioner no.3) assaulted his grandson through iron rod causing injury at his temporal region. Thereafter, Santosh Kumar (petitioner no. 6) caused injury at the head of his grandson, Raja Babu with lathi and Ashish Kumar (petitioner no.1) also assaulted his grandson. At that time, petitioner nos. 2 and 3 assaulted his daughter-in-law with iron rod causing injury at her elbow. Thereafter, all accused persons assaulted his grandson, Suman Kumar Nirala.

Learned counsel for the petitioners submits that, in fact, petitioner no. 1 used to run coaching centre and the informant and some others demanded ransom from petitioner no. 1 and also wants to get admission of wards in his coaching centre free of cost but petitioner no. 1 refused due to that reason

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Hisua P.S. Case No. 123 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
