JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code, Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act and Section 3/4 of the Explosive Substances Act.

The accusation is of making assault and abusing the informant by calling caste name.

It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.1037 of 2015 (2) dt.12-01-2015 2/2 in the background of serious land dispute, the accusation has been levelled and the injury has been found to be simple when there is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in connection with Chandan P.S. Case No. 45 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
