2. This application for anticipatory bail arises out of Purnea Sadar P.S. Case No. 99 of 2026 registered for the offence under sections 303(2) of the B.N.S., 2023.

3. The prosecution case, in brief, is that On 18.02. 2026, at 7:30 P.M., the informant went to Khushkibagh Phal Mandi near Hanuman Mandir to purchase fruits on his motorcycle bearing registration number BR11BE-1865. The informant parked and locked his motorcycle near a CCTV camera before leaving to buy the fruits. Upon returning, he discovered that his motorcycle was not found at the parking place.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.49961 of 2026(2) dt.22-07-2026 2/3 petitioner has falsely been implicated in this case. She is not named in the FIR and her name was added during investigation in the confessional statement of Md. Abdul @ Dacoit who is the relative of her husband.

5. Learned APP for the State vehemently opposed the prayer of anticipatory bail of the petitioner.

6. Considering the facts and circumstances of the case, it is quite clear that although the motorcycle has been recovered from the house of the petitioner where she resides with her husband but the name of her husband never surfaced during the course of the investigation, let the petitioner, above named, in the event of her arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court is connection with Purnea Sadar P.S. Case No. 99 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarika Suraksha Sanhita, 2023, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023 and also subject to the following conditions:

(I) One of the bailors shall be the petitioner's own or close member.

(III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.

(IV) The Petitioner shall not commit offence of a similar nature in future.

7. In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
