The petitioner has been in custody since 26.05.2018 in connection with Kathaiya P.S. Case No. 68 of 2018 registered for the offences punishable under Sections 363/366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that though it is alleged that the petitioner had kidnapped the victim girl, the victim girl in her statement made under Section 164 Cr. P.C. has categorically denied the same and stated that she, being a major, had married the petitioner out of her own sweet-will and has not been kidnapped by the Rahul Kumar, the present petitioner.

In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail

Patna High Court Cr.Misc. No.46134 of 2018 (2) dt.29-08-2018 2/2 on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub-Judge, 2nd Muzaffarpur, in connection with Kathaiya P.S. Case No. 68 of 2018.
