Petitioner apprehends his arrest in connection with Aurangabad (Mufassil) P. S. case no. 228/2013 registered under sections 341,323, 354, 504/34 of the IPC and section 3 (I) (X) of the SC/ST (Prevention of Atrocities ) Act, 1989.

It appears from the first information report itself that offence of section 3 (I) (X) of the SC/ST (Prevention of Atrocities ) Act, 1989 is made only against co-accused Ajay Kumar Singh and so far as petitioner is concerned, it is only stated that he pushed the informant in course of alleged occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, in my view, this anticipatory bail application is not hit by section 18 of the SC/ST (Prevention of Atrocities ) Act, 1989 and accordingly, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned

Patna High Court Cr.Misc. No.892 of 2015 (2) dt.09-01-2015 court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Aurangabad (Mufassil) P.
