JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the informant's son performed intercaste marriage which was not being liked by the accused persons as a result, the FIR named accused persons including the petitioner came when Mochi Sharma caused fire arm injury on the neck of the informant's son.

It is submitted by learned counsel for the petitioner that the overt act has not been alleged against the petitioner and the petitioner has been made accused in one other case after institution of the present case.

Considering the fact that the petitioner is not the assailant, let the above named petitioner be released on

Patna High Court Cr.Misc. No.850 of 2015 (2) dt.09-01-2015 2/2 anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Gaya in connection with Sasaram Rail P.S. Case No.46 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
