ANJANA MISHRA ORAL ORDER 10-08-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners have been in custody since 10.04.2018 on their remand in connection with Kankarbagh P.S. Case No. 141 of 2018 registered for the offences punishable under Sections 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that for the same motorcycle an Industrial Area P.S. Case No. 23 of 2018 had been lodged under similar sections and the petitioners were arrested in connection with the same offence and, thereafter, on their confessional statement, the alleged recoveries were made. It is further submitted that in connection with that case, the petitioner No.1 has already been granted bail. So far as the petitioner No.2 is
Patna High Court Cr.Misc. No.45821 of 2018 (2) dt.10-08-2018 2/2 concerned, the said motorcycle was recovered from petitioner No.1 and not himself. It is thus, submitted that since two cases were lodged for the same theft, the petitioner may be extended the privilege of bail as he has been granted the same in connection with the case filed earlier i.e., Industrial Area P.S. Case No. 23 of 2018 dated 17.07.2018.
In view of the aforementioned facts and circumstances that the petitioner No.1 Bikram Kumar has been granted bail in connection with Hajipur Industrial Area P.S. Case No. 23 of 2018 vide order dated 17.07.2018 passed in Cr. Misc. No. 41109 of 2018 and considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna, in connection with Kankarbagh P.S. Case No. 141 of 2018.
