The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 353, 323, 307, 337, 338, 427, 504, 506 of the Indian Penal Code and 3 of Prevention of Damage to Public Property Act.
Patna High Court Cr.Misc. No.23742 of 2016 (2) dt.26-05-2016 2/3 The prosecution case is that on 22.03.2016 in the evening the informant being police officer received information about confining a minor girl by teacher of Upgraded Middle School, Babhandi with bad intention. The aggrieved villagers have surrounded the school, pelting stones on the school and demanding the handing over of the girl. On information the informant being police officer and other police personnel and tried to pacify the matter but the mob raised slogan against the police for not taking action against the teacher. The mob pelted stones and bricks on the police personnel including the senior officers also. It is submitted by learned counsel for the petitioners that the accusation is against the mob. The mob was protesting against the police for not taking action against the erring teacher but the police in order to save its own skin lodged the present case.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of
Patna High Court Cr.Misc. No.23742 of 2016 (2) dt.26-05-2016 3/3 Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (M) P.S. Case No. 64 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
