====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-07-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Lalganj P.S. Case No.123 of 2018 registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(b)a/26/35 of the Arms Act.
Informant, who is a police officer, in his written complaint has stated that on 19.04.2018 at about 10:00 P.M. he was patrolling with other police personnel and he got information from the Officer-in-Charge that some criminals were coming from Muzaffarpur in a white car. Thereafter, he started checking vehicles at Lakhansarai and at about 4:25 A.M. one white Maruti Swift car came and seeing the police activity the said car stopped but petitioner along with other co-accused
Patna High Court Cr.Misc. No.45804 of 2018(2) dt.27-07-2018 2/2 persons started fleeing away. Petitioner was apprehended after chase and one succeeded in fleeing away taking the advantage of darkness. It has been alleged that one country made Sixer and one live cartridge were recovered from the conscious possession of petitioner.
It has been submitted on behalf of the petitioner that petitioner is innocent and he has falsely been implicated in the present case. No recovery of arms is made from the possession of petitioner. He has got no criminal antecedent. He is in custody since 21.04.2018.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No.123 of 2018.
