====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 11-08-2025 Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Amnour P.S. Case No. 132 of 2025 registered for the offence punishable under Sections 137(2), 96, 351 (2) and 3(5) of the BNS.

3. Allegation is of kidnapping of the minor daughter of the informant on the pretext of marriage.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and he has committed no offence as alleged in the F.I.R. Learned counsel further submitted that the victim in her statement recorded under Section 183 BNSS has not supported the allegation.

5. Learned APP for the State has vehemently opposed

6. Considering the nature of allegation made against the petitioner, learned District Court is directed to peruse the statement of the victim recorded under Section 183 BNSS and if the victim has not supported the allegation made in the F.I.R., then the petitioner, above named, be released on prearrest bail, on such terms and conditions as the learned District Court deems it fit and proper, in connection with Amnour P.S. Case No. 132 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS.

7. The bail application stands disposed of.
