2. This application is filed for grant of regular bail to the petitioner who has been made accused in connection with Excise Sadar P.S Case No. 168 of 2026 instituted for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 (as amended up-to-date).
3. The prosecution story, in short, is that the informant got the secret information and acting on that secret information, a raiding team was formed and conducted a raid at a warehouse near Gehumin Over Bridge under Mabbi Police Station. During the raid, five persons including this petitioner were found loading illicit liquor carton onto a Mahindra Pick Up vehicle
Patna High Court CR. MISC. No.51608 of 2026(2) dt.29-07-2026 2/3 bearing Registration No.- BR06GB-2395. Thereafter, the raiding team recovered a huge quantity of illicit liquor, and a total of 2220.600 liters and the pick up vehicle were seized.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case only on the basis of suspicion. It has further been submitted that no evidence, either direct, indirect or circumstantial is found against the petitioner.
5. It has been submitted that the petitioner was working in the alleged warehouse as a labourer and he is neither the owner nor he has any concern with the alleged warehouse. Also, the petitioner is neither the owner nor the driver of the seized pick up vehicle and he has no concern with the seized illicit liquor.
6. Learned counsel for the petitioner submits that the petitioner is in custody since 29.04.2026 and is having a clean antecedent.
7. Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court -
Patna High Court CR. MISC. No.51608 of 2026(2) dt.29-07-2026 3/3 1, Darbhanga in connection with Excise Sadar P.S Case No. 168 of 2026, subject to following conditions:- (i) One of the bailors should be family member of the petitioner.
(ii) Petitioner will co-operate in the trial and will remain present on all dates personally or should be duly represented through his counsel and whenever required to be physically present by the court, he should physically appear in the Court on that date.
(iii) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
