The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code to which sections 395 and 412 of the Indian Penal Code were added subsequently.

As per the prosecution case, four accused persons on the point of arms committed robbery.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against Ravi Sah and three others. The petitioner is not named in the F.I.R. The name of the petitioner transpired in course of investigation in the confessional statement of Rabindra Yadav and Guddu Yadav who have both been enlarged on bail vide order brought on record as Annexure-2 series. The petitioner has not been put on

Patna High Court CR. MISC. No.61558 of 2021(3) dt.10-05-2022 2/2 T.I. parade inspite of being in custody for more than a year. No incriminating article has been recovered from the petitioner's possession. He is in custody since 6.1.2021.

Having heard learned counsel for the parties and taking into consideration the petitioner not having been put on T.I. parade inspite of being in custody for more than a year and no incriminating article having been recovered from his possession, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.268 of 2021 (arising out of Mojahidpur (Babarganj) P.S. Case no.200 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge X, Bhagalpur.
