====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 19-08-2023 Heard Mr. Pankaj Kumar, learned counsel appearing on behalf of the petitioner and Mr. Nand Kishore Prasad, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Narhat (Sitamarhi) P.S. Case No. 340 of 2022, registered under Sections 341, 323, 504, 379, 427, 354, 307 and 506/34 of the Indian Penal Code.

3. The prosecution case, in brief, is that on 21.08.2022, while informant was engaged in measuring her house for the construction, all the accused persons named in the F.I.R., including the petitioner, variously armed with weapons came there and started assaulting her. It is further alleged that petitioner and one co-accused Shankar torn her Saree and blouse and snatched Rs. 5000/- and her ear-rings.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.52502 of 2023(2) dt.19-08-2023 2/2 petitioner submitted that petitioner is innocent and he has falsely been implicated in this case due to land dispute. He further submitted that co-accused has been granted bail vide B.P.No. 5323 of 2022. The injury sustained by the victim is simple in nature. The petitioner has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Having heard both the sides and the material available on the record as well as considering the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in connection with Narhat (Sitamarhi) P.S. Case No. 340 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Purnendu Singh, J) manish/-minu U T
