Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 323, 385, 506/34 and other allied sections of the Indian Penal Code. Prosecution's case in short is that the petitioners and 4 to 5 other accused persons came to the shop of the informant, pointed pistol and assaulted informant and others and took away cash and ornaments.

Patna High Court CR. MISC. No.61258 of 2021(2) dt.12-07-2022 2/2 Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is land dispute between the parties. Instant case has been filed by the informant to coerce the petitioner side to give up their claim over the land in question for which FIR has also been filed as contained in Annexure 1. Injury sustained by the informant has been caused by hard and blunt substance to be simple in nature. Considering the nature of allegation against the petitioners and the backdrop of the occurrence, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Patna in Digha Police Station Case No. 188 of 2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
