ANJANA MISHRA ORAL ORDER 23-08-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 07.04.2018 in connection with Sasaram (Town) P.S. Case No.456 of 2018 registered for the offences under Sections 147, 148, 149, 323, 325, 307, 341, 504 and 506 of the Indian Penal Code and Section 3⁄4 of Witch Protection Act. Later on, Section 302 of the Indian Penal Code was added.
Learned counsel for the petitioners submits that at best, the petitioners can be treated to be the members of the mob and no specific overt act has been attributed to either of the petitioners. It is further submitted that the petitioners are
Patna High Court Cr.Misc. No.45948 of 2018 (2) dt.23-08-2018 2/2 having clean antecedents and may be extended the privilege of bail.
In view of the aforementioned facts and circumstances, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Town) P.S. Case No.456 of 2018.
