JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Motipur P.S. Case No. 54 of 2012 registered for the offences punishable under Sections 272, 273, 467, 471 of the Indian Penal Code and 47 A of the Excise Act.

Taking into consideration that foreign liquor and sprit are said to have been recovered from the house of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Motipur P.S. Case No. 54 of 2012 pending in the court of Sub Divisional Judicial Magistrate, West Muzaffarpur stands rejected.

However, if petitioner surrenders before the court

Patna High Court Cr.Misc. No.1282 of 2015 (2) dt.13-01-2015 below within three weeks from the date of receipt/production of copy of this order to the court concerned and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this order.
