JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504 and 506 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that on the eve of flag hosting on the republic day, the petitioner abused the informant and threw the sweets.
It is submitted by learned counsel for the petitioner that the petitioner being the Secretary of the School Siksha Samittee, objected the illegal activities of the informant who is a teacher in the Middle School, hence the accusation has been levelled when the villagers have not supported the accusation. Learned Special P.P. submits that the occurrence took place in a public view.
Considering the nature of accusation, it is a case for consideration of regular bail.
Let the learned court below consider the regular bail of the petitioner if he surrenders within a period of six weeks in connection with Jamui SC/ST P.S. Case No. 04 of 2014 pending in the court of learned ACJM, Jamui.
Accordingly, the application is disposed of.
